Letter to the state:

Greetings,

Post the hearing of today it seems important to make sure numerous things are on the table for consideration.

There is a fundamental issue of the only item that seems to be addressed is funds, while other issues, such as my ability to communicate with my kids at least weekly by phone, the right to send my kids uncensored mail, to be informed or involved in my kids health and education, are denied to me.

This leaves an unfortunate but obvious question. I am being require to pay for the support of Gloria-Jane, Walter, and Zadok, but have no knowledge if they are even alive. There are over 6 years of phone calls that are refused and documented at http://Family.Kozlowski.org. There are now over 100 returned mail pieces to my kids documented at http://Kozlowski.org/Promise,Refused. If the state law it to be applied, is it all of the law or only just about funds?

It should be noted that the last phone call I had with my kids was in 2016 and my objective of reconciliation was directly addressed. There has been no dialog since.

My wife and I married with the understanding that our reference was the Bible and our allegiance is to Christ. While the evidence is overwhelming that my wife no longer uses the Bible as her reference (see Romans 7, 1Co 6, and 7 to start), but has turned to the state as her lord. However, in obedience to Christ I will not turn from her and will only seek reconciliation. While I understand this has no relevance to the state, it is noted to make sure it is clear that my goal is reconciliation and in no way revenge.

For about ten years I did nothing to address the payments required of me, but simply paid them when funds allowed. However, it was clear that the information used to calculate the amount owed over the years was incorrect. There are the obvious issues of actual income by my wife and me. The minimum wage figure was used for my wife. She has purchased a house and put 5 of our kids in private school. Unless there is other support, this suggests the minimum wage figure is incorrect.

My income stopped about half way through 2022 and I currently have no income, so I assume the minimum wage figure would be used for me. I am surviving on funds provided for the http://ShofarLeaks.com project which addresses the issues that inspired my wife to abandon our marriage. Again a focus of that project is to provide a means for reconciliation, which is what I am seeking with my wife and others.

On October 19, 2022 in response to my request I was given the link https://www.tn.gov/humanservices/for-families/child-support-services/child-support-guidelines.html. From there I downloaded the file “Income Shares Worksheet 2021 v1.0”. In the instructions for Line 5a there is an error that I initially did not catch. It states “For the Parenting Time Adjustment, use the formula (69 - Line 5 Avg Parenting Time / 365)”. Since my time is zero, the results is always 69 irrespective of income. The formula should be written “(69 - Line 5 Avg Parenting Time) / 365. The closing parenthesis is in the wrong place. This was determined once I received your calculated version on January 5, 2023.

The spreadsheet provided is locked, so I had to do the calculations manually. I did sent my calculations on January 23, 2023 using my 1099 for 2022. However, since my income has been zero for about 8 months, my assumption is the minimum wage figure would be used. In either case, the amount contrasts radically from what is being required.

The only reason I requested the review is that the state locked my bank account, which impacted my eating habit. My assumption is that my wife would have the ability to simply stop this process, but that would only be based on a mutual effort toward reconciliation, which is currently not present. It remains my hope for the future.

In summary it seems that if a full year-by-year review were done with actual income figures from both my wife and me, plus the actual number of kids under my wife’s care, the supposed arrears amount might instead be my payments being ahead of what is required. If I am now to be paying for Gloria-Jane, Walter, and Zadok, proof of life seems also in order.

Finally, let me reiterate, I love my wife and am only seeking reconciliation!
