Greetings,

 

As previously suggested, it appears what has happened is that the general issue of what payments I am required to send to my wife has focused on the single question of if a particular calculation is correct. As also previously acknowledged, with the data used the calculation is correct. There is no challenge to that calculation. However, what has happened is the fundamental issues are now simply ignored citing jurisdictional limits or simply no response on the issue from Tennessee Child Support.

 

It should also be noted that unlike my wife, I did provide information on income several times. However, as that information was updated, it was simply ignored. To make things simple I requested to at least update the monthly amount for 2023 alone, but that request was also ignored. I contend unless it can be shown that my $486 amount is inaccurate, the required $888 for 2023 is simply theft.

 

While the May 10, 2023 document seems to accurately report many things that have appeared in correspondence, what is missing is glaring. There is what seems to be a simple emotional statement that my wife “lives economically”. It is an interesting contrast that as far as I understand she drives a Suburban, and I have not had a vehicle in over 10 years, and have only driven once in the last 3 years. However, what relevance does any of that have to the calculations at hand? It seems to be just an appeal to emotion fallacy.

 

On April 11, 2023 I sent an email which showed my calculation of $486. At the end of the email the habeas corpus issue was brought up. With that in mind, if Tennessee Child Support or the court is stating that I must pay $888 to my wife for the care of Gloria-Jane, Walter and Zadok, prove that they are alive! This is not a trifle request, but a serious concern from a dad, who against state law, has been kept uninformed and out of communications with my kids for about 7 years. If you are insisting that I pay for my kids, prove that they are alive!

 

While it is only the single calculation issue the court seems willing to address, Tennessee Child Support should not only address funds but all of the decree that my wife signed that gives this dad the right to speak at least twice weekly to my kids, and be able to send uncensored mail to them. Over 1,700 voicemails covering over 2,400 days plus about 200 returned mail items, including in the last week that are all publicly documented at http://family.kozlowski.org, are unambiguous evidence that my wife is in violation of the agreement. If the role of Tennessee Child Support is to support children, does that not include all of the related laws? Does that not include the right of both parents to engage and love their kids?

 

In summary, the court is correct in that using the data specified the calculations are correct. The issue remains that the data used is fundamentally incorrect.

 

The request has been made and evidence given that at least for 2023 the amount should be $486. I again request that Tennessee Child Support acknowledge this and update the claim or show where my calculation is wrong.

 

And fundamentally, I request proof that the funds required for the last 6+ years be demonstrated as actually required by giving evidence that my kids are alive as I have seen none.
