Docket No. CS 230100309 - Case 1844859 - Petition for Modification response

Greetings,

On May 16, 2023 I sent an email concerning this matter noting that the February 23, 2023 hearing was on a minor issue and the major issues remain unaddressed (http://kozlowski.org/Promise,Gov-2023-05-16+1).

On May 17, 2023 I received a phone call stating I had not made a payment recently (http://kozlowski.org/Promise,Gov-2023-05-17+1). It was noted on that call that assuming the $486 amount, that payments were made this year to cover January through May. I was told a document would be sent to petition the court for a modification of the rate. It arrived that weekend (http://kozlowski.org/Promise,Gov-2023-05-17+2).

What was sent was yet another issue being put on the table, that being Gloria-Jane becoming emancipated. This was obviously news to me as I have had no information or contact with her in years. With that in mind my calculation are now that it is no longer $888 or $486, but $422 per month. The calculation is as follows and a review is requested:

Part II. Adjusted Gross Income

Mother or Parent1 \ Column A Father or Parent 2 \ Column B Nonparent Caretaker \ Column C

1,316.02 1,256.00

1 Monthly Gross Income $ $

1a Federal benefit for child + 0.00 + 0.00

Use Credit Worksheet 1b Self-employment tax paid - 0.00 - 0.00

to calculate line items 1c Subtotal 1,316.02 1, 256.00

1e Credit for not-in-home children - 0.00 - 0.00

2 Adjusted Gross Income (AGI) $ 1,316.02 $ 1, 256.00

2a Combined Adjusted Gross Income $2,572.02

3 Percentage Share of Income (PI) 51% 49%

3a Means Tested Income only (Y/N) N N

Part III. Parents' Share of BCSO

4 BCSO allotted to primary parent's household $ 724.00 $ 0.00 $ 0.00

4a Share of BCSO owed to primary parent $ 0.00 $ 354.76

4b BCSO if Self Support Reserve (SSR) is applied N/A N/A

5 Each parent's average parenting time N/A N/A

5b Adjusted BCSO (68 or less days) N/A N/A

6a Parenting Time Adjustment (92 or more days) N/A N/A

6b Adjusted BCSO (92 or more days) N/A N/A

7 Calculated BCSO $ 0.00 $ 421.82

In reading the mailed document it appears that the state is making some requests that I am not asking for, but it requires my signature as the petitioner. Yes, I agree to point #3 that the amount should be modified. However, point #4 suggests that I would no longer be me making a payment, but a direct seizure from my paycheck. This is academic in the sense that I am not employed, but concerns me that it is a vehicle for the state to garner additional control. Point #7 seems to be a threat to my wife to have her license suspended and I have no such desire. Point #8 is simply a repeat of point #3.

Because of points 4 and 7, I do not think it is wise to sign the document as received. I do not know which individual or group should be addressed to resolve this.

But there remains the glaring fundamental issue that has not been mentioned by anyone but me. Are my kids alive? If I am to pay my wife to support our kids, I respectfully request proof of life.

My suggestion of a good way to validate that my kids are alive is to simply follow the document my wife signed on October 30, 2012 (http://kozlowski.org/Promise,Gov-2012-10-30+10). Such as allowing this dad “unimpeded telephone conversations” which has not occurred since 2016 (http://kozlowski.org/Promise,Gov-2012-10-30+11). Or being able to “send mail to the child which the other parent shall not open or censor”. I have about 200 mail items returned with images online (http://kozlowski.org/Promise,Refused).

So perhaps we should first verify that my kids are alive or this is simply theft. What is the best way to proceed?

Respectfully,

John Kozlowski
